What Happens if the Defendant Accidentally Misses Court?
If the defendant you have bailed out of jail misses his or her court date, an arrest warrant will be issued whether the failure to appear is accidental or not. The bail bondsman will also receive a notice of the failure to appear. That’s why it is extremely important, of course, that you do everything you can to make sure the person you bailed out does not miss a court date. Not only will the existing bond be forfeited, there are substantial costs involved in petitioning the court to reinstate bail. If this does happen, you need to notify your bail bond company right away so that arrangements can be made.
